dc.description.abstractThe paper aims to identify regulatory questions that have been challenged before the Brazilian federal justice system by entities representing regulated agents and consumers, and the courts’ decisions regarding public policies proposed or adopted by ANATEL [National Telecommunications Agency]. Understanding the way Brazilian judges and courts address policy issues in telecommunications may help move towards a better understanding of how the Brazilian regulatory state has been molded in recent years, and to what extent the roles attributed to the technocracy and the judiciary have promoted a rearrangement in the division of tasks among branches of government.en
