Abstract

This paper (in Spanish) brings attention to the search for balance in protecting plant breeders’ and farmers’ rights to keep and exchange seeds. A legal framework with better integration of public policies is required. Within the context of patents on life forms, it is important that seed regulation should recognize farmers as traditional plant breeders whilst establishing identification criteria and appropriate certification to preserve, conserve, exchange, sow, multiply and disseminate high quality seeds of native strains. It is necessary to apply new legal tools to integrate the formal and informal seed system.
